Missed deadline does not result in loss of child benefits

Merely missing a registration appointment at the employment agency without an excuse does not justify that the agency stops the job placement without notification and thus the entitlement to child benefits ceases.

A child registered as a jobseeker who does not receive any benefits from the employment agency and merely fails to comply with their general obligation to register with the employment agency does not commit a breach of duty that leads to the loss of child benefit. The Rhineland-Palatinate Fiscal Court thus partially upheld the claim of a father whose daughter had broken off her training due to a problematic pregnancy and had failed to attend an appointment at the employment agency without giving any reason.

The agency then deregistered the daughter from the employment agency. However, the plaintiff's daughter, who was not receiving any benefits from the employment agency at the time, was not informed of the termination of the employment agency. The tax court considered this termination of the employment agency without informing the daughter to be unlawful and therefore granted the child benefit entitlement for the statutory period up to the daughter's 21st birthday.
