No compensation for prolongation of proceedings due to pandemic

Procedural delays caused by the Corona pandemic do not fall within the state's sphere of influence and therefore do not give rise to a claim for compensation.

Anyone who suffers a disadvantage as a result of unreasonable length of court proceedings shall be adequately compensated. However, this right to compensation requires that the circumstances that led to an increase in the duration of the proceedings must lie within the state's sphere of influence. Therefore, a delay in the session of a fiscal court caused by the Corona pandemic does not lead to the unreasonableness of the duration of the court proceedings because it is not within the state's sphere of responsibility. On this basis, the Federal Fiscal Court dismissed the claim for compensation.
