WSB about the number of the month: What the time change also has to do with working hours

One is the number of the month. To be more precise: On Sunday, October 27, the clock will be set back from three o'clock in the morning to two o'clock. Will you have to work an extra hour?

If you have to work at night on October 27, you should know the following:

Your obligation to work does not automatically increase just because the night lasts longer. The regulations in the collective agreement or works agreement are decisive.

If nothing has been agreed between you and your employer, case law states that you must still work the additional hour in case of doubt. This is because the courts grant the employer a legitimate interest in avoiding gaps or overlaps between shifts.

Is the extra hour paid? That depends.

Sometimes not: If there is a provision in your employment contract according to which a certain number of overtime hours are covered by the gross monthly salary, your additional working hours will also be covered.

Sometimes it is: If a fixed weekly working time is stipulated in a collective agreement and overtime pay is regulated, the hour must be paid or added to your working time account if the weekly working time is exceeded.
