If you maintain a second home for professional reasons, you can deduct your accommodation costs of up to EUR 1,000.00 per month as income-related expenses. This maximum limit applies to rent payments, ancillary and operating costs, cleaning costs and the second home tax, among other things.

Due to increased rent and energy prices, the limit is quickly exhausted, especially for second homes in large cities.

Fortunately, there is now new tax-saving potential!

The Federal Fiscal Court (BFH) has ruled that the costs for a parking space at the place of employment do not fall under the 1,000 euro limit.

You can therefore deduct your parking space rent without restriction!

The only important thing is that the costs were necessary. However, the hurdles here are low: in the case in question, a reference to the tight parking situation in Hamburg was sufficient.

It is also irrelevant whether you rent the parking space together with the apartment or through a separate rental agreement - possibly from a different landlord.

However, the tax offices are currently still instructed to include parking space costs under the 1,000.00 euro limit.

An objection is worthwhile! 💡

If the tax office reduces your income-related expenses, thanks to the BFH you now have a good chance of taking action against this with reference to the new case law!
